Terms of Service

Overview

These Terms of Service ("Terms") govern your use of Form Link — including the iOS app, the Chrome browser extension, and the web application at form-link.ai (collectively, the "Service"). By creating an account or using the Service, you agree to these Terms. If you are accepting on behalf of an organization, you represent that you have authority to bind that organization.

The Service is operated by DATAWAND LLC, a limited liability company ("we", "us", or "our"). Questions? Email [email protected].

1. Eligibility

You must be at least 13 years old to use the Service. By using the Service you represent that you meet this requirement. If you are under 18, you represent that a parent or legal guardian has reviewed and agreed to these Terms on your behalf.

2. Accounts

You must register an account to use most features of the Service. You are responsible for:

• Providing accurate registration information and keeping it up to date.
• Maintaining the confidentiality of your credentials.
• All activity that occurs under your account.

3. Subscription and billing

Plans and credits

The Service is offered on a subscription basis. Each plan includes a monthly credit allowance used to perform AI-assisted form capture and data extraction. Credits reset at the start of each billing period and do not roll over. Unused credits expire at the end of each period.

Free trial

New accounts may be eligible for a free trial. Trial terms (duration and credit limit) are displayed at sign-up. At the end of the trial, continued use requires a paid subscription. We reserve the right to modify or discontinue trial offers at any time.

Payment

Subscriptions are billed in advance on a monthly basis. Payment is processed by Stripe. By subscribing, you authorize us to charge your payment method on a recurring basis until you cancel. All fees are in US dollars and are non-refundable except as required by law or as described in the Cancellation section below.

Cancellation

You may cancel your subscription at any time from Dashboard → Billing. Cancellation takes effect at the end of the current billing period; you retain access to paid features until that date. We do not provide prorated refunds for partial billing periods.

Plan changes

Upgrades take effect immediately. Downgrades take effect at the next billing period. If you downgrade to a plan with fewer credits than you have already consumed in the current period, usage is not reversed, but your next period will start at the lower limit.

Price changes

We may change subscription prices at any time. We will give you at least 30 days' advance notice of any price increase before it applies to your account.

4. Acceptable use

You agree not to use the Service to:

• Violate any applicable law or regulation.
• Infringe the intellectual property rights of any third party.
• Upload or transmit content that is unlawful, harmful, defamatory, or obscene.
• Attempt to reverse-engineer, decompile, or extract source code from any part of the Service.
• Circumvent or interfere with rate limits, credit limits, authentication, or security controls.
• Resell, sublicense, or provide access to the Service to third parties without our written permission.
• Use automated means (bots, scrapers, or scripts) to access the Service in a manner that exceeds normal human usage.
• Use the Service for processing forms containing protected health information (PHI) under HIPAA unless you have a signed Business Associate Agreement with us.

We reserve the right to suspend or terminate accounts that violate these rules.

5. Google API services — Limited Use disclosure

Form Link's use of information received from Google APIs, including the Google Sheets API, adheres to the Google API Services User Data Policy, including the Limited Use requirements.

Specifically:

• We request access to your Google Sheets only to write extracted form data to the specific spreadsheet you select.
• We do not read, store, or use Google Sheets data for any purpose other than completing that export action on your command.
• We do not transfer Google user data to third parties for advertising or for purposes unrelated to the core export functionality.
• We do not allow humans to read your Google Sheets data except where required by law or with your explicit permission for a specific support request.

6. Your content

You retain ownership of all content you capture, upload, or export through the Service ("Your Content"), including form images, extracted data, and templates. You grant us a limited license to process Your Content solely to operate and deliver the Service to you. We do not claim any ownership rights in Your Content.

You are responsible for ensuring you have the right to capture and process any forms or data you submit through the Service.

7. Intellectual property

The Service, including its software, design, trademarks, and content (excluding Your Content), is owned by DATAWAND LLC and is protected by intellectual property laws. These Terms do not grant you any rights in our intellectual property beyond the limited license to use the Service as described here.

If you provide feedback or suggestions about the Service, you grant us a perpetual, irrevocable, royalty-free license to use that feedback without restriction or compensation to you.

8. Third-party services

The Service integrates with third-party services (Google, Stripe, Supabase, Cloudflare, Sentry, and others). Your use of those services is subject to their respective terms and privacy policies. We are not responsible for the acts or omissions of third-party providers.

9. Disclaimer of warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DATA PROCESSED THROUGH THE SERVICE WILL BE ACCURATE OR COMPLETE.

10. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, DATAWAND LLC AND ITS MEMBERS, OFFICERS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE SERVICE.

OUR TOTAL LIABILITY TO YOU FOR ANY CLAIMS ARISING UNDER THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO US IN THE 12 MONTHS PRECEDING THE CLAIM OR (B) $50 USD.

11. Indemnification

You agree to indemnify, defend, and hold harmless DATAWAND LLC and its members, officers, employees, and agents from any claims, liabilities, damages, and expenses (including reasonable attorneys' fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

12. Termination

You may stop using the Service and delete your account at any time from Dashboard → Settings → Delete Account.

We may suspend or terminate your account if you violate these Terms, if required by law, or if we discontinue the Service. We will give reasonable advance notice where possible. Upon termination, your right to use the Service ends immediately. Sections that by their nature should survive termination (including Sections 6, 7, 9, 10, 11, 13, and 14) will continue in effect.

13. Governing law and disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law provisions. Any dispute arising from these Terms or your use of the Service shall be resolved exclusively in the state or federal courts located in Delaware, and you consent to personal jurisdiction in those courts.

Before initiating any legal proceeding, you agree to contact us at [email protected] and give us 30 days to resolve the dispute informally.

14. Changes to these Terms

We may update these Terms from time to time. If we make material changes, we will notify you by email or via an in-app notice at least 14 days before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Service and delete your account before the effective date.
